Copyright law is actually a hell of a lot stricter then most people realize. Theres some good sites wandering around the interhighway that clarify how copyright law works. For one, the idea that you have to profit off a copyrighted work for it to be illegal is untrue. I remember one site that showed a lot of the common mistakes and many were quite surprising!

it has two words in it, "copy" and "right". So you can think of it as the author retaining his right to copy his work, no matter what circumstances.

As a small interlude, as you may know i worked as professional bondage rigger/photographer a while back. And to be honest...if I see one of my images posted somewhere without permission, I ask for it's removal.

See, professional Bondage images don't come for free. You need good equipment- camera, lighting, studio, props...you need a model, you need perhaps some more people who can lend a hand with all things. All of this costs cash, and not a little.
If someone decides to give their images away for free- fine to me. But if they don't want that, you should respect that.

Contrary to what most may beleive, most "professional" barely break even. Only the biggest sites get some real $ from the stuff.
So, if you like the stuff, I think it's only fair to give back a little. And not to "steal" their work.

Well my rant is ended, hope no harm is done :)

And you have the permission to post it anywhere on the net?
Somehow, I have my doubt about it....

i.E. if you buy a music CD, your are (usually) not allowed to post the songs to anyone on the net.
Same with software. And same (as here) with pictures

anyway, it's a rather old debate...it's just my personal view that the creative people who create the stuff we like should be respected.

Just because somthing has a copyright symbol by it, doesn't make it copywritten.

This is a little shaky ;)
Generally, if you were i.E. a work of art (who may know :D ) you could be copyrighted.

Joke aside, basically everything which is a quote "original work of authorship fixed in a tangible medium of expression". The (C) is merely a hint (and a reassurance) that the author/photographer/whatsoever wants this to fall under this protection.

In case of this photo- do we know for sure? no. Because we may not even know which country's law would be apropriate.
However, it has long been my opinion (in several other BDSM related forums, too) that we should honor the wishes of those who create such works, as, after all, they provide us with the visuals to our dreams.
And I can tell you, from my own experience and from others, no one has gotten rich so far by producing such stuff ;)
