The Death Penalty.

Do you think it should be given as form of punishment?

My thoughts are just like that of Hammurabi's Code, an eye for an eye a tooth for a tooth.

What do you guys think?

My problem here is the obvious one: false trials.
If you give someone life and they turn out innocent you ruined their lives, but they could pick up the pieces. Harder to do when you killed them :\

But if it was ever possible to determine 100% sure if someone was lying or not, I think death is justified.

I agree with Nuclearo. If the evidence is so overwhelming (videotapes of the act, at least ten positive eyewitrness accounts, DNA corroboration, etc) that guilt is obvious and we're talking murder, then there should be a death penalty. But too many people have been convicted on hearsay evidence (a single person indentified them - and got it wrong!), particularly if they were non-white, and later found to be innocent. I think death penalty should be reserved only for especially heinous crimes where guilt is beyond any doubt at all (not just reasonable doubt, which apparently isn't enough) to ANY unbiased person. The standards for guilt are just too darned LOW these days, where you're practically presumed guilty until proven innocent rather than the other way around! Presumption of innocence is only a concept in courts these days; not the reality. In an atmosphere of cynicism like that, the death penalty is as evil as the crime it is meant to punish.

Only if it is a 100% that he's guilty
I think the family of the victim should have a say in it as well.

Yeah but the problem is you can't be 100% sure of anything non-mathematical in real life. Let's say you have video, witnesses, fingerprints and DNA. The vid and witnesses can be fooled with extremely intricate disguises, the fingerprint and DNA could be planted. No matter where you draw the line of probable doubt, it could be fooled. You could make someone else guilty or yourself be innocent.
