It has come to light that the FBI have copied Megaupload hard drives.

There was to be a hearing about how these drives were to be treated.

As the FBI have underhandedly subverted the process, it brings their basic honesty into question.

Also, not only pirated data will have been copied, but the intellectual property of millions of people. This presumably was why there was going to be a hearing.

If law enforcement agencies are willing to violate intellectual property laws, how can it be expected that anyone else will keep to them.

Well, the FBI is a subordinate division of the Department of Justice.

The Department of Justice is headed by Attorney General Eric Holder. (Yeah, THAT Eric Holder, the guy appointed by Obama, who is dangerously close to being in contempt of congress, and who is up to his eyeballs in the "Fast and Furious" scandal.)

I'm starting to think that actually bringing a prosecution against Megaupload was not part of the plan. Any chance of prosecution in New Zealand or a successful extradition after this action is virtually nil.

The target was probably just the data. It may already be in the hands of the music and film industries, and soon invoices claiming large sums of money will be on there way to any address they can find. It won't matter if you own the account, just if your name and address is found somewhere in the data.

A similar scandal happened once in the UK, but they used lists of IP address, and it was then challenged because it was thought that the company doing this was making up details as well.

It would seem that the 'free' press is about as trustworthy as the federal law enforcement.

The biggest worry for those with their files stored with Megaupload should not be whether or not their files were copied.

It should be whether or not their files even exist. Copying files can take time, so these 'people' may not have time to copy everything.

Degaussing a hard drive, however can take only seconds.

Any organisation that is prepared to subvert the legal and due process systems of a country in an unbelievable act of intellectual property violation, would have no qualms about destroying data.

Hell, I wrote off all my own Megaupload files months ago anyway. I'm just glad I never wasted money on their premium service to obtain long-term storage service.

No they're not dead but they're heavily abused and in severe need of reform.

I've read stories where someone claimed copyright infringement because someone took a picture of their burger for god's sakes!

Not to mention ACTA, TPP, SOPA, PIPA, etc. It's gone completely crazy!

These Copyright Maxilmists need to be stopped as their not only hurting the internet but innovation as well.

Also if you actually read the copyright laws, you can be quite surprised.

The laws tell you what you are permitted to do with copyrighted materials. The laws were written before reproduction equipment was made.

Because of this you are not permitted to reproduce or perform copyrighted material in any format.

This means that whenever you play a CD or watch a video, you are breaking statutory criminal law. Which means all of us are multiple criminal offenders under the law.

Before anyone mentions about the long blurb at the front of a video, saying all this "Licensed for home use, blah, blah." please note that this at most counts as a private agreement, which is superseded by statutory law, making it invalid.

Megaupload raid warrant 'invalid', New Zealand judge says

The search warrants used to raid the home of Megaupload owner Kim Dotcom were invalid, a New Zealand judge has ruled.

Action by the FBI to copy data and take it offshore to the US was also deemed unlawful.

"The warrants did not adequately describe the offences to which they related," High Court judge Justice Helen Winkelmann said.

Mr Dotcom was arrested, along with four others, in January.

Millions of dollars in assets were seized or frozen including almost 20 luxury vehicles, dozens of computers and art works.

However, Justice Winkelmann said the warrant for the search fell "well short" of outlining Mr Dotcom's alleged offences.

"They were general warrants, and as such, are invalid," she said.

In response to the judge's decision, New Zealand police said they were in discussions with Crown Law "to determine what further action might be required".

Mr Dotcom's site was said to have made $175m since 2005 by copying and distributing copyrighted material without authorisation.

The site's lawyers have said Megaupload simply offered online storage.

Mr Dotcom is currently on bail.


It would seem that the FBI are now also in trouble in New Zealand.

What the bloody hell is the FBI doing in New Zealand? Why didn't they go to the New Zealand national police and courts with their "evidence," and make sure they were in compliance with New Zealand laws??

Well, considering the clowns running the Justice Department, specifically Eric Holder, who is about to be hit with a "contempt of congress" citation, I am not surprised with yet another display of ineptness from a cabal of losers that couldn't find their asses with both hands and a flashlight.

One thing that surprised me is that the Fox News Website has broken the wall of silence on this in the USA.

People might now start asking major questions about the DOJ's and the FBI's behaviour.

As I have said above Drawscore, I think that the real target was getting data so that the movie and record companies can get lots of invoices sent out to people, demanding say about $1000 from each 'offender'

Hell, I'm not surprised that Fox News broke the story. Fox seems to be the only media entity that comes close to holding politicians accountable. Our founders gave us a free press for the purpose of being a government watchdog. Unfortunately, most of the alphabet soup of broadcast and cable networks, and the majority of the newspapers, are more like government lap dogs.

The next big day for the FBI is today as they are taken to court by the Electronic Frontier Foundation.

Friday Hearing in Megaupload Case Over Users' Rights

Abraham Sofaer Joins EFF in Fight for Return of Property

Alexandria, VA - The Electronic Frontier Foundation (EFF), assisted by retired federal judge and former State Department legal adviser Abraham D. Sofaer, will ask a federal judge Friday to order the return of data to Kyle Goodwin, a Megaupload user who lost all access to his files when the cloud storage service was shut down by the U.S. government.

Megaupload.com and related sites were seized in January as part of a copyright infringement investigation. But in addition to the alleged illegal activity by some Megaupload users, many innocent customers used the service to store legal material. The government has failed to help Goodwin and other lawful Megaupload users get access to their data, despite months of legal wrangling. In Friday's hearing, EFF and Sofaer will ask the court to establish a procedure by which innocent users will be able to reclaim their property, as is routinely required in the seizure of non-digital items.


We may very well see the FBI now fight against the concept of 'Intellectual Property' and the existence of computer files. Yet theses files seem to have enough existence and 'IP' capability when they want to prosecute.

The real reason, which they won't admit unless they are forced to, is that checking all of the users' accounts and all of the files by sight is a massive, almost impossible task.

EU AXES ACTA

The Europoean Union have voted against ACTA by ten to one. This is a law that would send you to jail for TEN years for illegal downloading. So Downloading Michael Jackson's picture will give you a two and a half times more sentence than actually killing him.

It seemed that the hurdle of the European Court of Justice was too high to jump over.

The truly ridiculous thing is that when you browse the internet, your computer stores the data in a cache, which means that you have downloaded it.

Therefore everything that you look at is on you PC as well.

As you have not got express permission of copyright, this means that when you look at any website with images and text, you are breaking the law by copying copyrighted information.

This would also mean that anyone browsing the web would commit countless violations of ACTA.

The copyright laws are a pre 20th century invention and they need to be updated for the 21st century. Sorting that out could take decades

The news on this seems to be spreading.

This is too much of a coincidence, and the whole incident now smell of political corruption and subterfuge.


If the Republicans have any sense they should make maximum use of this. If they don't it will show that they are just as much in bed with the MPAA and RIAA as the Democrats and it shows who's really running the country.

These people on Megaupload have had their IP taken from them unlawfully and is now in the hands of the USA.

The presidency now looks like it is under the control of the RIAA/ MPAA, who also control the FBI.

How long before people are forced to have RFID tags implanted which music and video devices check to see what you are doing.

And the reported registered users on Megaupload?

66.6 million
