I wish people wouldn't talk on cell phones but I hesitate to say that should be illegal. While people can't really do it despite their apparent belief otherwise I could see a potential emergency requiring a use of the phone. Texting is different as it takes your eyes off the road.
I have to agree with Snobound on this, there are a lot of people that can't drive on a clear day and a good road with no distractions, much less trying to look at a phone.

In one case, the person doing to texting got herself killed when she got so distracted she went right off the road and nearly smashed into a TV News truck! She slammed into another car; I can't remember now if anyone else was killed. She was a student at the local University.
IMHO texting while driving is no better than driving while drunk!
