road rage

some guy cut me off. He got out of his car, screamed at me, cursed at me, and ran off. I never felt so scared before because it was the 1st time I faced road rage. But I said nothing and stayed in my car until he drove off. Crazy?
You will have to subdue me to restrain me. I been a bad boy so make sure you torture me too with anything but pain.

Crazy? He- yes. You- no.
Arguing in such situations tend to end up not too good, often enough in a brawl. And IMHO, in such a brawl you loose, no matter if you get beaten or beat the idiot up.

Or, as they say..."There is no point in arguing with idiots. They drag you down to their level and beat you with experience in there".

Immediately, pick up your cell phone and call the police about an attempted assault in progress. Do not pass go, do not collect $200. some of these idiots have guns. Drive away is the first option of course. the second is above. Stay safe.

The smartest thing to do then is to stay in the car. Nothing good can come out of leaving the car. If the other person actually does decide to do something really crazy like attack you (contrary to what is said above, shouting is not "attempted assault" unless a threat is made), you're in a safer position.

Actually Kyle, if an average person would feel he is about to be attacked, it is an assault. Sometimes people confuse it with a "battery" which is an unlawful touching. My advice still stands. By the time it escalates to a battery, it may be too late.

Actually, you have to prove there was a good reason to feel threatened, not just say "I felt it." Otherwise, you can cover quite a lot by saying "I felt in danger."

Depending on what the guy was saying and/or how he was acting COULD potentially be considering threatening. Shouting at someone is not, in itself, a threat, even if it is done in anger. Continually harassing someone, acting as if you may legitimately attack, or of course, actually stating you are going to attack them means they are a threat. To be fair, I'm not sure exactly what Jay meant happened. I read it purely as it was written and only wrote a post based off that.

You're right Kyle -- the test the courts use is the "reasonable man." if a reasonable man in similar circumstances would feel personally threatened either to himself or another then it is a civil and likely a criminal assault. Any touching of course would make it a battery as well. Strange, I think there was a road rage killing just today in the US. Best advice --- don't stick around to engage --- just get out of there.
Interesting though, your example was often used as justification in a 20 year period West of the Mississippi River. About 1880 to 1900. The Wild, Wild West.

So right! Stay locked in the car and drive away if you can. While the nutcase is acting out of control and crazy, you should stay as calm and in control as you can. Call the cops to ask for help and don't hang up. Stay on line. If the dispatcher or officer hears the rant so much the better and they may charge disorderly conduct at the least.

Once a man followed my little brother home being psycho, my brother only being 16 was so scared when he got out he picked up a baseball bat on the lawn and hit the guy so hard it sent them to the hospital.... I'm his legal guardian so I had to pay for the mans hospital bills

Stuff like this is one of many reasons I quit driving a long time ago. There's something about driving that apparently makes some people psychotic!
