Same-Sex Marriage now permited in all 50 states

In a 5-4 decision the United States Supreme Court has declared that same-sex marriage is legal across all 50 states and say that same-sex couples are entitled to all the same rights as heterosexual couples.

Should have been 9-0. If anything was a no-brainer it was this one. The fact that it was so close is very VERY scary to me.

I'm frankly surprised that it came about at all.

What I worry about is he religious fanatics ginning up hysteria about it.

They just seem to want to inspire another Charleston type atrocity to come about.

Decisions can be reversed, but it generally takes a long time. The most prominent reversal was Plessy v. Ferguson (1898). 56 years later, that decision was reversed by Brown v. Board of Education of Topeka. (1954).

Other notable reversals, were the income tax, declared illegal by the Supreme Court, reversed by the 16th amendment, and the Dredd Scott decision, reversed by (I think) the 14th amendment.

Then there was a complete defiance of a court decision, back in the early 19th century, when a decision came down, and the president, who vehemently disagreed, said something to the effect of "They made the decision, now let them enforce it!"

And, of course, the Supreme Court has no enforcement powers. That function falls to the Department of Justice, a part of the executive branch.

While not having anything to do directly with same sex marriage, I can see at least one unintended consequence of the decision. If states must allow same sex marriage, and recognize such marriages performed in other states (full faith and credit clause), it could be argued that states must also recognize and honor concealed weapons carry permits from other states.

Several states grant reciprocity, others do not. My CWCP would be honored in Florida, but not in New York. This decision may require New York to honor CWCP's from other states.

One area where there is reciprocity, is in motor vehicles. All states (and Canadian provinces) recognize and honor license plates and drivers licenses issued by other states/provinces.

This could be interesting, watching the politicians and the courts contort themselves, as they wrestle with the unintended consequences of the decision. And I love watching politicians squirm.

In the past, marriage certificates from heterosexual marriages were recognized by other states, or if anything it only took a little paperwork. This is nothing new. It just extends that coverage to non-heterosexual marriages.

It's fantastic to finally be progressive rather than locked in stone age policies here in the states! Kudos for the right decision being made. And I am saying this as a straight guy, I am proud of the decision!

It would have been nicer if it had come about through the popular vote of the people; though I think it would have sooner or later anyway. My state was the first to legalize same-sex marriage in this way rather than through the fiat of a court; it feels - less imposed on people - that way.
