What are specifc rules about pictures?

This isn't really a comment or a suggestion, but I was wondering what I would have to do if I wanted to post a picture that wasn't mine. I find a lot of pictures online, as we all do, and in the rules and guidelines post it is stated that you must source it properly, for some things is that literally just adding a link to the original site of the photo, eg deviantart? And what if the picture was actually from somewhere else but you found it on another site, like a blog or something, can you just link the blog?

Thirdly, can we post any picture, or do we have to have specific permissions?

I would recommend getting permission. More often than not, a picture will get posted, and the owner/originator may have an objection for various and sundry reasons. When that happens, the picture is usually pulled, or, if it is not, a moderator is contacted.

If you know to whom it belongs, it would be prudent to send a PM to the owner, along with a copy of the picture.

I, for one, have a decent collection, but because of an incident several years back, I no longer post them, and, when I run across one, I send a PM to the poster, asking that it be taken down.

just post a link to whatever site you pull it off of, doesnt need to be the original.

Then you take your chances. You go ahead and post, and if you don't get any complaints, you're golden. But you also post a disclaimer, something to the effect of: "These photos were downloaded from the internet, and nothing indicated ownership. If you see any of your pictures here, and do not wish them to be posted, please PM me with the picture location/number/description, and I will delete it." And, make sure you follow up on it, preferably within 24 hours. If you don't, then the mods or owners get "nastygrams," asking that the picture(s) be taken down. Having been a mod myself, I didn't like getting "nastygrams" from PO'd members. I don't imagine the mods here like it, either.

Wouldn't it be simpler to go by the rule: if it's not yours, don't post it?

Well I like to look a pictures of bondage, so I know I would appreciate it if other people were to share photo's with us, and secondly I was going to try a story where I used pictures to help illustrate the scene, pictures that I had found on the internet.

Probably true, but there are some out there that have been around for as long as I have been a member of this board, and longer. "The boy in Red" being one example. After a while, these become "public domain," and if no one has complained about them in the amount of time they have been around, then they are probably OK to put up.

Personally, I don't want any of mine up, and will certainly complain if I see any. The exceptions would be vidcaps and comic book covers or art, which are almost universally available.

This is not correct. It depends heavily on the juristication you are under. And just because "it has been around so long" and "no one got caught" this doesnt mean it's legal.

Usually, people who publish pics somewhere do this for a reason. And I think it's only fair to respect this reason. So, if the owner wants to share it- fine. But if he doesnt, that should be respected.
So, if it's not yours, and you don't know the owner (or his view on things getting posted elsewhere) dont post it.

Besides, illegaly posting copyrighted stuff means you put the site itself here in danger, not just yourself. More than one site has been shut down because of such issues...and there are some producers of bondage material out there who are going very heavy on sites posting their stuff.

This was the rule when I first started the section, but then found out that a lot of our posters dont take their own photos. So I added a rule to post where you got it from.

Me, I just post my own drawings, although some of my older ones do have some elements taken from clipart. However, all clipart I used for background is tagged as royalty free and intended for general use, so there are no awkward permissions to worry about.

I think this is a really tricky rule, because no matter how you slice it, somebody isn't going to be happy.

As a writer who writes for his own benefit, I would say that you shouldn't post content that isn't yours. Unless otherwise stated, content (Like Pictures and Stories) belong to the owner, and reposting it would be stealing.

Even if it's clear what your restrictions are, emailing or PMing the original owner of the content is a fair idea. Utherwise, just post a link to the original content.

Passage into "public domain" occurs when the copyright expires. Usually 14 years, but it can be renewed for another period of time. Lots of comic book publishers in the 30's and 40's have merged with others, or have gone out of business; copyrights were not renewed; and those works became public domain, and may be freely copied and distributed without penalty.

There is also "fair use," which means that a portion of copyrighted material may be used without penalty or royalties being paid. An example of this, would be a commentator on Fox News, using a clip from MSNBC, to make a point, or a book reviewer using direct quotes from a book he is reviewing.

Copyright law can be twisted and complicated, so, if it IS copyrighted, doing research on the legality of its use, might be wise.

That's only one juristication. For example, many countries (including mine, Germany) don't have the "fair use" paragraph. If it's copyrighted, you are not allowed to use it without permission, period (under the laws here, of course). And I am pretty sure other countries have even more varied laws on this. International copyright is a pit of snakes, ya know :D
